There is no grace period for auto insurance in general. We contacted the insurance regulator of Georgia who confirmed that GA does not have a grace period for car insurance. If your insurance has canceled than there is no extension of that coverage. Typically an insurance policy will cancel at 12:01 AM of the date indicated on your auto insurance payment notice.
The Office of Insurance for Georgia also stated to us that a certified letter is not required. Typically your payment notice can also be your cancellation notice since on there it states that your policy will terminate at a certain time and date if you do not pay before that date.
Georgia Code 33-24-44 notes what insurance companies must do regarding cancellation notices. Here it states in part that:
Written notice stating the time when the cancellation will be effective, which shall not be less than 30 days from the date of mailing or delivery in person of such notice of cancellation or such other specific longer period as may be provided in the contract or by statute, shall be delivered in person or by depositing the notice in the United States mails to be dispatched by at least first-class mail.
Here is some information on how insurance information is transmitted to the state and what your penalties may be for having a lapse in insurance in the state of Georgia.
In Georgia insurance companies issuing or renewing motor vehicle liability insurance policies are required to electronically transmit the vehicle's identification number (VIN) along with the policy's effective date to the GA Department of Revenue's Motor Vehicle Division insurance database within 30 days of the date the insurance coverage is to begin. This database is called the Georgia Electronic Insurance Compliance System or GEICS and insurers must electronically report terminations and additions or deletions of vehicles from existing policies as well.
If your insurance lapses, due to non-payment as in your example, your insurance company would send the GA Department of Revenue (DOR) a notice of insurance termination. If a Notice of Insurance Termination is received by the DOR, thirty (30) days is given for new insurance information to be electronically transmitted by an insurer to this Department's insurance database.
If there is a lapse in insurance coverage the aforementioned Notice of Lapse in Mandatory Liability Insurance Coverage is mailed to the vehicle's registered owner requesting the payment of a $25.00 lapse fee within thirty (30) days of the date on the notice. If the owner pays the $25.00 lapse fee within the thirty (30) day time frame given, a valid insurance coverage indicator will remain on the vehicle's registration record.
If the owner fails to pay the $25.00 lapse fee within the time frame given (Thirty-days from the date on the Notice of Lapse in Mandatory Liability Insurance Coverage), it will result in the suspension and/or revocation of the vehicle's registration. When this happens, a Notice of Suspension is mailed to the vehicle's registered owner advising him or her that their vehicle registration has been suspended and what is required for reinstatement.
If the vehicle's registration is suspended or revoked, it may result in a period of time of up to six (6) months during which the vehicle's registration cannot be renewed or reinstated and/or the imposition of fees up to $160.00 in addition to the $25.00 lapse fee. To drive this vehicle while the registration is suspended, revoked or cancelled is a misdemeanor.
Additional penalties will apply if the vehicle owner has been convicted of driving with a suspended or cancelled registration. Police will know if you are driving without insurance or with an invalid registration since law enforcement and the County Tax Commissioner office personnel in this GA have access to the tag and title database and can easily check the insurance status of any vehicle registered in the State of Georgia.
The GA DOR states that if you plan on taking insurance off of a vehicle you may voluntarily cancel your vehicle registration with your County Tax Commissioner’s office without surrendering your vehicle's license plate (tag) when the vehicle is not going to be driven. Remember to avoid any lapse and restoration fees from being charged, you must cancel your vehicle’s registration before canceling your vehicle’s insurance coverage.
