Does North Carolina fall under the "no deductible" for windshield replacement? If so, do you have the statute?

In North Carolina there was a House Bill in March 2005 entitled "an act to eliminate the automobile insurance comprehensive deductible on motor vehicle windshield glass" introduced to the NC state senate.

The wording of this bill showed that the authors of the Bill wanted to amend G.S. 58-36-65 by adding a new subsection to read:

"(n) The subclassification plan shall provide that the comprehensive coverage deductible shall not apply to motor vehicle windshield glass. The deductible provisions of any policy of motor vehicle insurance for either comprehensive property damage or any combined additional insurance delivered or issued in this State by an insurer authorized to write motor vehicle insurance in this State shall not be applicable to damage to the windshield of any motor vehicle covered under that policy." This bill requested this act to become effective when it becomes law.

From the research we have done it appears that the bill was referred to the Commission on Commerce and has not yet moved forward and become part of NC law. Until this is accomplished the comprehensive deductible would be due unless your insurance company decides to waive your deductible for front windshield repair or replacement.
